Terms of Service

The rules for using fluos. Plain language where we can; precise where we have to be.

Acceptance of terms

By accessing or using fluos, you agree to these Terms of Service (“Terms”). If you do not agree, do not use the Services.

Who may use the services

You must be legally able to enter into a binding agreement and comply with applicable laws. If you use fluos on behalf of a company or organization, you represent that you have authority to bind that entity.

Accounts and security

  • You are responsible for maintaining account confidentiality.
  • You are responsible for all activity under your account.
  • You must promptly notify us of suspected unauthorized access.
  • We may suspend accounts to protect users, systems, or rights.

Subscriptions, billing, and credits

Paid plans are billed in advance according to your selected plan. Credits are consumed based on usage. Unless stated otherwise, purchased subscriptions and credits are non-refundable to the maximum extent permitted by law.

  • Free-tier credits may be limited and may not reset.
  • Paid-plan credits may reset by billing period per plan terms.
  • We may change pricing with reasonable advance notice.

Acceptable use

You may not use fluos to violate law, infringe rights, or create, distribute, or facilitate harmful, abusive, deceptive, or unlawful content.

  • No unlawful, fraudulent, or infringing use.
  • No attempts to bypass security or platform safeguards.
  • No unauthorized scraping, reverse engineering, or abuse of APIs.
  • No misuse of generated media to impersonate or deceive.

Your content

You retain ownership of the content you upload, submit, or create in fluos, including prompts, projects, assets, and outputs (“User Content”). Ownership does not depend on whether you use a free or paid plan.

You grant us a limited license to host, process, store, reproduce, and transmit User Content solely to provide and improve the Services, maintain security, and comply with law.

If you use a free plan (or free-tier entitlements), you also grant fluos a worldwide, perpetual, royalty-free, sublicensable license to use, reproduce, modify (for example, crop, caption, or create a thumbnail), publicly display, distribute, and promote the outputs you create with the Services—including exported or generated videos and related promotional stills derived from them—for fluos marketing, promotion, education, and demonstration, without further approval or compensation. We are not obligated to credit you. On reasonable request we may stop future use where feasible, but we are not required to recall materials already distributed. This marketing license does not give fluos ownership of your User Content, and it does not authorize reuse of your source uploads (such as logos or footage) outside showing them as they appear in those free-tier outputs. Outputs created while you were on a free plan remain subject to this marketing license even if you later upgrade; outputs created under a paid subscription are not covered by it.

On a paid plan, the marketing license above does not apply to content you create under that paid subscription, except where you separately agree (for example, a case-study or testimonial consent). Paid-plan content is covered only by the limited service license described above.

You represent and warrant that you have all necessary rights, permissions, and legal bases for any User Content you submit.

AI outputs and responsibility

Generated outputs may be probabilistic and may not always be accurate, unique, or suitable for your intended use. You are responsible for reviewing outputs before use, publication, or reliance. Ownership of outputs and the licenses you grant us are governed by the Your content section.

fluos does not guarantee that outputs are error-free, non-infringing, or fit for any specific purpose.

Intellectual property

The Services, including software, models, UI, and branding, are owned by fluos or its licensors and protected by intellectual property laws. Except as expressly permitted, you may not copy, modify, distribute, sell, or sublicense any part of the Services.

Third-party services

fluos may integrate with or link to third-party services. Those services are governed by their own terms and privacy practices, and fluos is not responsible for third-party products or policies.

Suspension and termination

We may suspend or terminate access if you violate these Terms, create risk or harm, fail to pay fees, or where required by law. You may stop using the Services at any time.

Upon termination, rights granted to you under these Terms end, except provisions that by nature survive termination.

Disclaimers

The services are provided “as is” and “as available” to the maximum extent permitted by law. fluos disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.

Limitation of liability

To the maximum extent permitted by law, fluos will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business interruption.

To the maximum extent permitted by law, fluos’s total liability for all claims arising out of or relating to the services will not exceed the greater of: (a) the amount you paid to fluos in the 12 months before the event giving rise to the claim, or (b) USD $100.

Indemnification

You agree to defend, indemnify, and hold harmless fluos and its affiliates, officers, employees, and agents from claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Services, User Content, or violation of these Terms.

Governing law and disputes

These Terms are governed by applicable law as determined by fluos’s principal place of business, excluding conflict of law principles. Venue for disputes will lie in the competent courts of that jurisdiction unless otherwise required by law.

Changes to the services or terms

We may modify the Services and these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting updates on our site or in-product). Continued use after the effective date means you accept the updated Terms.

General terms

  • These Terms are the entire agreement for your use of the Services.
  • If any term is unenforceable, the remaining terms remain in effect.
  • Failure to enforce a term is not a waiver.
  • You may not assign these Terms without our consent.
  • We may assign these Terms in connection with a reorganization or sale.
